In every residential area, there are houses that violate the development plan and still are not demolished. Then a small fine is just paid.

No, at least in the development plan you quoted, something different is stated:

The reference point is always the natural terrain profile at the valley-side edge of the house up to the intersection of the exterior wall with the roof skin, measured on the eaves side.

So the side is taken where the natural terrain profile is the lowest.

You misunderstand me. The plot is completely flat. Everything filled up to zero level, no slope or anything else. The house there has a single-sided shed roof. Shortest wall height 6m, longest wall height 9m:

No, I do understand you correctly. Has your surveyor already created an elevation profile? Or why are you so sure? If the “wrong” side is also only 1cm lower, you’re out of luck. That’s how I would read your development plan anyway. But in case of doubt, your architect should clarify that with the building authority.

What do you mean by 1cm lower? The short side may be 7.5m high for the shed roof. In this case, it is only 6m high and the total height may be 10m, and here only 9m was reached.
