Exemptions in the building permit

Hello everyone,

after almost 5 months we have now received our building permit.
I have a question for the group about how to interpret this.

So, the development plan says this:

Garages and covered parking spaces must be attached to the main building, only allowed with a gable roof or a sloped shed roof.
The roof pitch of the garage roofs must be at least 25°.
For green roofs, lower roof pitches (at least 10°) may be permitted.

In the building application, we had planned a double carport attached to the house with a green flat roof. In the drawings, we wrote "Exemption flat roof".

The building permit now says this:

"According to §§56 para. 6, 74 para. 1 no. 1 of the State Building Code in conjunction with no. 2 of the local building regulations, an exemption is granted regarding the obligation to green the carport."

So actually we wanted the exemption for the flat roof but have now received an exemption for the greening.
But the drawings were approved with a green flat roof; can I now assume that I can build a flat roof without greening?

Attached to the house, I read that as at least 10° pitch remaining required, but exempt from the greening otherwise required below 25°.

I read it as the approved flat roof including the greenery. Could it be that 10 degrees is still considered a flat roof by the building authority? I would not build without greenery in that respect.

No, it is precisely the greening that is being removed - and only that. So not the fact that even a flat roof must have a 10° pitch, if the carport is attached.

But in the plans it is clearly drawn as a flat roof without inclination - and those were approved. Just without a text section about it. Or does this sentence about the roof pitch maybe only apply to garage roofs and not to carport roofs? I also don’t know what the "local building regulation No. 2" is supposed to be. I think I really have to inquire at the office...

You quoted it like this, probably from the textual provisions of the development plan, and there is presumably a "2." before it. The regulation calls a carport a "covered parking space." You said it is attached to the main building, so: 10° roof pitch are likely applicable there.
