Yesterday I was doubting - a bit. But after the message from Dirk I think: The plan could definitely work. Clever. I'm keeping my fingers crossed!!!

The portion of the property without a building envelope can possibly be designated as meadow without having to create a separate parcel from it. The property tax might then be lower for the meadow portion. For recurring contributions (if common in your municipality), the method of calculation used by the municipality is decisive; in this case, a division could mean a financial advantage over time. You need to clarify this locally with the municipality. The notary and court fees will not change as a result, since the overall value does not change. The surveyor will set two additional boundary markers. You can inquire about the exact costs from them.

I think you should inform yourself about the costs of a land partition. The statement "the surveyor would come anyway" is true, but for your partition not much will happen under €2,500. All other services come on top.

I can also quickly lay it out for you, but it’s actually more sensible if you immediately go to a colleague on-site. He will either burst your bubble right away or it will actually be worth it. But that can’t be clarified here in the forum or without the info I mentioned above.

We will probably not be able to pursue the topic further for time reasons. Until the end of 2015, the purchase of the property and submission of the [BA] are still planned. That will already be challenging enough.

I can only repeat: get in touch with a [öffentlich bestellter Vermessungsingenieur]. The division will be more expensive after the development because then you will need a division application. If it goes really badly, the division might not be possible at all.

All the [öffentlich bestellter Vermessungsingenieur] on site needs is the [BA] and a red line with the planned boundary. So make a copy of the building application, draw in the planned boundary, scan it, and send it to a [öffentlich bestellter Vermessungsingenieur] on site with a brief description of the purpose of the division. You need a surveyor anyway, possibly one is already involved (through [AR]/builder!?) and he can answer this question independently of the [BA] in 5 minutes.
