Please be more detailed instead of simply accusing the OP of a criminal offense. For example, it would be helpful to extract from the subsidy conditions whether the use of the second residential unit as such is actually required. At least it is not immediately clear to me. Only structural requirements can be identified. Unfortunately, you are only provoking.

so for our 2nd residential unit it only had to be a separate apartment in our house. But since it is on the ground floor for us, we are also getting a special wall as a partition between the apartments, not a normal room wall.

We don’t have to charge rent for it, according to the bank, KFW advisor, and our tax advisor, in our case my father will just live in it now. (As soon as the house is finished, we are already living in a house anyway)

What will happen with the apartment later is to be seen, but I don’t think the kfw necessarily requires that you have to rent it out.
Otherwise, why don’t you get advice directly from the kfw?

The use, i.e. rental, of the second residential unit probably does not have to take place, but from the TE you can read that the second residential unit is only to be created when the rooms on the upper floor are no longer needed for family use as such. Only then is the upper floor to be used as an autonomous residential unit.
In this respect, no two residential units are being provided here, but only one with an option for a second.

In this respect, a single-family house is being built here - no more and no less.

What will be subsidized or supported in 20 years, we do not know. Maybe there will be something like housing subsidies, then one can still see to what extent conversion or redevelopment will be done.
