Construction contract before financing

Our developer has provided all the information upfront that we needed for the financing. Now we have the bank-signed loan agreement at home, and the appointment to sign the developer contract is imminent. We have not signed anything yet (except the financing request). We will sign the loan agreement in a few days, then the withdrawal period will start. Within this period, we will sign the developer contract. (If not, the financing will also be reversed without any costs.)

So it really depends on the provider. We also had one (!) conversation where it was said: At the next meeting you will sign the contract! After some back and forth, there was no further meeting (the provider starts with m and ends with assa).

Now I have received a special agreement stating that if the monthly financing installments exceed xx Euros, there is a right of withdrawal free of charge.

It won't be phrased that bluntly. What exactly does it literally say in this agreement? The entrepreneur will hardly agree that you construct the installment amount in such a way that it exceeds the maximum monthly financing installment. There will be a little checkbox somewhere.

we included a right of withdrawal, where we could have gotten out of the construction contract free of charge if they hadn’t given us a loan. we only briefly told the builder what we do for a living and how much equity we have, and he added this clause without hesitation. we received all the necessary KFW documents one week later, with which we then got the final financing confirmation. at that time, the building notification had already been created because the builder had already started, although contractually he wanted to start only after the financing confirmation.

it is quite a paradox in the story. one doesn’t want to without the other. the kfw should maybe be a bit more relaxed. the application for a new building is just pro forma anyway and is approved once all data is available. so why can’t the financing be approved beforehand (on the condition that the documents are submitted) and the necessary documents (basically it’s just the sheet that shows the consumption/kfw value) be submitted later?
