The amount is not worth arguing with a friend. Agree on 50 50 and that's that. You also bear some responsibility if the communication with the buddy doesn't work.

As the [Bauhaerr], you could always have stepped in if something was not executed as agreed.

No, exactly not...

Where am I supposed to intervene when I look at the construction site in the evening and everything is completely covered with gravel, although this was never talked about? :D that's really nonsense now.

So the fault definitely lies 100% with the civil engineer. Now the only question is how much one should give in here...

Honestly, I tell you... friend or not, but I now have enormous additional costs for which I am really not responsible at all. I still have a pile of dirt at the back that has not been removed yet and a large part of the garden area full of gravel, which brings me nothing at all and will cause me problems with the outdoor area (planting a tree, etc.? How is that supposed to work with such a subsoil??).

And now I am supposed to say: Yes, let's just do 50/50 and that's that?

If you want to dispute it, then take the proper route. Deficiency notification and request for rectification. Then the costs for the contractor will be so high that they will give in. But please, everything in writing. You can see what else happens otherwise.

Yes, definitely we are on the safe side "legally"... no question. As said, none of this was included in an offer or in the bill of quantities.

Ultimately, one has to say clearly: The construction site didn’t really "interest" him... it just went along as a favor – as mentioned, normally the civil engineer works on entirely different projects in other areas with higher amounts. That is ultimately what bothers me – just sending such a "trial calculation"... But whatever, maybe on site it will go in a direction reasonable for us.

Of course, that should not be the goal. Well, we’ll see how the conversation goes. If no proper solution-oriented approach is pursued, then the invoice simply won’t be paid for now – period.

That doesn't solve a problem, it rather creates more. Agree among yourselves.
