Hello Allen, We have started earthworks at our semi-detached house. During the survey, it turned out that the neighbor has exceeded his distance to the street. His shell construction and roof are almost finished. If we simply continue, the roof will not match the neighbor's. Could you give advice on how we can solve this.. Thanks in advance,

Where exactly does it say that you must keep a 3m distance from the street? The street is often partially included in the calculation of the clearance areas.

That is a nasty dilemma. If you adapt, you violate your building permit, if you build according to the building plans, you cause technical problems and violate the development plan, if it includes design regulations for semi-detached houses. I think you cannot avoid involving the approval authority, even if this may have consequences for your neighbor.

But he could get a new permit if it complies with the regulations under the new conditions, couldn't he?

You write, "abstand zum strasse ueberschritten hat" A violation of the distance is rarely a problem. Otherwise, what wrote applies.

How many cm are we talking about?

At least did the neighbor respect the boundary to your house?

Hello,
My boundary is adhered to.
Because of the 50 cm exceeding, his house is close to the street and 70 cm inside the building line on the backside.
So he must insulate on my side and I vice versa.
The roofs do not match.
If the city grants him a special permit, I have to bear the insulation costs.
Thank you again,
