Building a structure at the setback area or at the slope boundary

Good day,

I am planning to build a pool which is supposed to be roofed in the final construction stage. Now I would like to know if I understand the state building regulations correctly. If I build a pool house / garden house between the pool and the property boundary, let’s call it a structural installation, to which the pool roof will ultimately be attached (for this I will probably need a building permit), I might have to comply with setback distances. However, if I terrace my sloped property and lower it about 1.4 m just before the property boundary and support it, can I then build directly there??

The state building regulations § 6 says:
Setback distances in special cases
(1) The following are permitted in setback distances of structural installations as well as without their own setback distances:
1.
Buildings or parts of buildings with a wall height of not more than 1 m

If the building is about 2.20 m high and is located 1.40 m lower, does the wall height then count as 0.80 m?? Intersection of the wall with the ground surface??

Hello, thank you very much for the response. I just became aware of this... however, "independent embankments and excavations up to 2 m in height or depth" are exempt from procedures in BaWü. To what extent does this now restrict the original question?

"Verfahrensfrei" only means that a formal building permit is not required. The regulations must always be complied with nonetheless.

Is a pool - whether with or without a roof - even privileged?
