Broker fraud or tax evasion?

Really? I only know it this way so far, apparently the broker was also present at the notarization. It’s just one sentence, but brokers are usually very slow with that. But out of interest: is it included now?

You absolutely have to explain this theory to me in more detail. For that, he would have to earn most of his income from salaried employment and only work as a broker on the side. Or he understands the turnover limits in such a way that only money processed through the books counts, and mainly lives off undeclared money. Does he have the website on the darknet so that customs have overlooked it for twenty years?

Thank you all for your answers. He wanted a commission confirmation from us in mid-December. We were supposed to write in there broker commission 7% incl. taxes. We found a template, entered the property, and sent it to him. It probably isn’t worth doing anything and just paying. That’s what we want too. It was clear from the start that we have to pay 20,000€ commission, that doesn’t bother us either. He also received the commission confirmation before the deadline for splitting the commission costs... We are just very puzzled about the tax and don’t understand it at all. What would you do now? Just pay as well? @ well, theoretically he could be employed somewhere and only run this company as a side business and make sure to stay below the small business threshold, right? I can’t check that... But why then did he offer us cash without tax if no tax applies anyway?

If both parties agree that the 7% should be paid, then it's fine. But I would still run it through the books. It's unnecessary, but I would ask about the broker's license, I can't imagine how a broker's license and [Kleinunternehmerregelung] could be compatible. One of the two is not there :)

Never worry about other people's heads. He gets 20, you pay 20, how he taxes it is none of your business.

Well, the website will have an impressum. You can check which company/companies are registered there and then look up capital companies in the Bundesanzeiger. You can also obtain an extract from the commercial registers.
