Hello,
Regardless of the fact that the status quo probably cannot be changed anymore and assuming the excavation itself was part of the scope of work:
- was the disposal of the excess soil clarified before the contract was awarded?
- how was the general contractor commissioned for removal/deposit?
- or no contract at all, the general contractor just hauls it away and sends an invoice?
By the topsoil, you probably mean the topsoil, which is normally removed and stored on the property if space is available. For one meter of clay soil and the rest gravel (which will be reused), the price of roughly 22.00/m³ is already at the upper end of the scale.

you know my general contractor anyway,
I was on vacation and got the offer on Friday (but I wasn’t there) and on Monday the excavation was done. I didn’t really have a choice and I never confirmed it either.
Gravel for backfilling was stored, no idea if there is still some topsoil underneath/behind it.
A correction, 217m³ hauled away for 3654 net, so 4350€ in total, meaning 20€ per m³, the rest was 5€ per m² for clearing all the blackberry bushes and tree stumps etc.
Furthermore, according to the offer, nearly 22€ per m³ with roots would have been charged, although more than 20m³ of those accumulated, they were not billed.
