I would have kicked him out long ago, especially for the money you're paying. Sorry for you, but that really sounds bitter. You want things to move forward, but the old guy doesn't even use the second/third/x-th chance.

The payment schedule was posted by sichtbeton82, I don't understand why you want to expand the payment schedule by an additional metric "presence on the construction site"? You won't get far with that, whether he is also the construction manager or not.

If the ground floor construction plan is missing, everything from including the performance phase 5 onwards is not yet completed, so already overpaid, you can pin him down on that. I wouldn't even start with the lack of presence in your position, because that only gives him a template that makes your claim/your objection flawed and vulnerable.

Under no circumstances would I pay anything else. He should rather break down what his invoice is based on for you. May I ask how much 18.5 percent of your construction sum is?

What nonsense! : I can neither understand your architect's billing, nor your behavior of having paid so much so far, nor the "reference" with discouraging words. Somehow, it all seems a bit off. What advice can one give from the outside?

I can understand your attitude, yet it is not universally valid. Exactly for the points mentioned, one commissions a construction management, which, by the way, is also liable for it.

Lumpi_LE, well, he looked more like 66-68. I only found out when I saw his Architektenkammer certificate on Fratzbuch. You don't really ask something like that. Besides, he seems energetic, so that's not the reason.
