I don't mean it personally: But are you really sure you want to build now? During the construction phase, quite different things happen and the dear craftsmen only want your best: your money. So get out of this contract, pay the tuition fee, maybe wait a few more years, collect equity & life experience.[emoji1]

Uhh, a really dumb question: Have you found a suitable plot of land?
What if you still don't like it (e.g. too expensive)?
The statement is basically, if no land purchase takes place, then no house construction contract will be concluded, right?

You can save yourselves the lawyer, Max will come to a settlement plus lawyer costs. Pay up or cooperate with them!

The 10% clause is probably valid, but it is difficult to say without the full context (see § 649 Baugesetzbuch, where only 5% is provided as the standard, but deviations are possible for real estate). In consumer contracts, it always makes sense to take a closer look; in individual cases, certain provisions may be invalid due to a violation of [AGB]-related regulations. The accompanying circumstances of the contract conclusion can also be relevant.
