Well, they can always say that they were, among other things, busy with a property search for you. That means: financial compensation for their efforts. Unfortunately, that's how it is. But given the amount, I would also advise consulting a specialist lawyer - it's not an insignificant sum: at least an initial consultation should be possible.

Let's put it this way. The lost profit because the TE successfully acquired a property is; and yes, with nothing standing in the way of the signed contract for work, it just makes the matter protracted. (It is also hard to argue that the profit margin is significantly lower).

You also can't just simply rely on a failed financing or something similar.

Don't get upset. Salespeople are trained to enable exactly such things.
