Use of public street land / paving / garden gate

Hello,

hopefully this is the right subforum.

We are currently planning our garden fence. In doing so, a question has arisen regarding the use of the area in the access driveway to the property.
It concerns the small section between our driveway and the street (see picture).
We would like to pave this area between the folding rule and the driveway in order to install a small garden gate.
Our property boundary runs directly along the driveway.

The street is the responsibility of the local city. Therefore, I would have to apply for permission to use this area. What exactly would one apply for here, or is there a legal norm that one can refer to?
What are the chances that the city will approve such a request? In other residential areas with a similar situation, I have noticed that such areas have been paved afterward.

That depends on what the city has planned there. I find the geometry a bit strange. A development plan excerpt and a cadastral map excerpt would be helpful.

Hm fence and thus gate belong on the own property. Why should the gate be somewhere else?

Even if it probably won't bother anyone, since apparently only a green strip is planned, I wouldn't want to approve a special use permit as a municipality. There seem to be some utilities running there. If digging occasionally needs to be done, a source of conflict will have been created over who moved or damaged which paving stone and when. But it doesn't hurt to ask.

I may have expressed myself somewhat unclearly here. The fence and the gate are of course on our property. What I mean is that the access way to the gate should be paved. This concerns the roadside strip.



That is correct. Only a few grass seeds were spread on the area in question. Yes, utilities run in the street. But is that reason enough for rejection? I’ll just try it with the mentioned special use application and can then report back on the response.
