If the contract said "financing confirmation," I wouldn't have any qualms about it; but it explicitly says "an unconditional payment obligation from a credit institution licensed in Germany."
Since the company is a major German prefabricated house manufacturer, I assume this exact wording was chosen deliberately.
So, now I'll go earn the money that is at stake here :-)

If I remember correctly, there was exactly such a wording in the contract on the green forum. The bank then paid directly to the builder, even though the service had not yet been rendered, and the client had no leverage. I no longer know how the case ended.

Not to diagnose excessive paranoia, rather healthy, adult caution, which is very important and purposeful for the success of a major project.

It is not for nothing that it is said "look before you leap"; this also applies to contracts!

There are companies which – due to their long history – include this clause in the contract. Interestingly, with the comparatively low amount at the bottom right, the willingness of clients to withhold funds unjustifiably also increases. In this respect, I can understand the arguments of both sides.
