Trees on the property driveway

Hello everyone,

on our property where the driveway will be built later, there are 3 trees. Do you have to submit a separate application to fell the trees, or does the approval of the driveway also serve as permission to have them cut down? How does this work exactly? The driveway was approved by the municipality, but the trees are not shown on the plan. What is the proper procedure?

It primarily depends on the type of tree, the "tree protection statute of the municipality" and other (e.g. nesting protection) laws.

Isn't it the case that the trees should have been entered in the building application?

I am only somewhat familiar with this, but we had to fell a tree, the architect entered the tree species and trunk diameter and the corresponding permit was granted or it was communicated that the tree is not among the protected trees, but one must adhere to the rules regarding nesting periods.

Hmm, well, our architect didn't include any trees at all. I'll just say they really are just ordinary trees, not those huge thick ones, rather small but still there :-(

Get the statute of the municipality for the protection of trees and then find out if your trees are affected.

The statement 0815 trees does not matter here.

If, for example, we have a 0815 beech with a trunk diameter of 15cm, then you can reschedule or, with luck, achieve a discharge trade, meaning plant a new tree of the same species and pay 500 euros into the city coffers.

In addition to the building application itself, an open space plan must often be included in the appendix - all trees and also those to be felled must be included there. It leads to the funniest situations: a tree must not be felled and is directly in front of the garage -> garage not usable,.... Your architect should know this and be familiar with the relevant municipal regulations, after all, that’s what you pay for.
