Hello,
We bought land and a house through a developer. The land is created by dividing a large plot into more than 20 smaller ones by the developer.
According to the development plan, the developer must plant 20 trees on the undivided plot (one per parking space). Most of these trees are planted outside the 20 resulting plots, but also one on ours. Unfortunately, he does not want to negotiate either the species or the location of the tree.
According to the Berlin Tree Protection Ordinance, trees with a certain trunk diameter may be cut down without permission, provided they are not compensatory plantings.
So are we allowed to simply cut down the tree after moving in? If not, are we allowed to replace it with another species in a different location?
