Tolerance for floor area ratio? Penalty for exceeding?

Hello,

according to the development plan, we have a floor area ratio of 0.4. Currently, exactly 40% is built/paved.

However, we still need to pave an additional 15 sqm for the garbage bin storage area and the access to the garden shed, which brings us to about 42% coverage.

Are there any tolerances here, and if so, how high are they?
Do they need to be approved?
What would be the approximate penalty for non-compliance?

P.S.: I understand that only the responsible building authority can say this with 100% certainty. Please therefore simply assume the average/established values.

No! Penalty = dismantling. But it is calculated differently depending on the federal state. For example, an exceedance up to x is allowed due to ancillary areas. House area is not equal to ancillary area.

Check the BaunutzungsVO. Exceeding up to 50% is allowed up to a floor area ratio of 0.8 and even slightly above, which, however, requires separate approval. This concerns structural facilities; whether the garbage bin area and paved paths are included is the question.

Can't you create a compensatory area? For example, a greened garage or trash bin roof. Alternatively, make the path permeable to water.

What does water-permeable mean? Paved is not permeable, right? The garage has a flat sheet metal roof made of sandwich elements.

Grass pavers, for example, are permeable.

Eco paving also, but I believe only 50% is allowed to be deducted.
