Hello everyone,
since we do not know what else to do after having tried everything imaginable, I hope for some advice here that might still help us out of this mess.
Brief introduction:
At the end of 2016, we signed our owner-occupied home contract with Deutsche Fertighaus Holding Group (Allkauf Haus). At the beginning of 2017, the foundation plate was finally poured and our house was erected. We also purchased the interior finishing of the house, as well as the electrical and sanitary work, from Deutsche Fertighaus Holding. The subcontractors for these services were provided by Deutsche Fertighaus Holding.
During the expansion of our house, there were repeatedly issues that should not have occurred.
- Roof not properly sealed
- Wet insulation installed
- Passages from the factory dimensioned too small
- Electrical cables forgotten during pre-assembly
- Cigarette butts stuffed into the holes for sockets
- Front door scratched
- Several electrical cables perforated
- and so on and so forth.
But which builder does not know such problems. Some more, some less.
I want to spare you the long version of the story, so - long story short:
We have been living in our house since mid-2017 and there are still outstanding defects that have not been rectified.
- Window sills not installed according to standards, causing loud echoing during rain
- Filling work Q2 throughout the house (walls, ceilings) / statement from the site manager Deutsche Fertighaus Holding “that is rather Q0”.
- Underfloor heating circuit for the living area partially installed in the hallway on the ground floor
- Hot water only after more than 50 seconds (up to the 60 degrees regulated in the standard, far over a minute) and above 5 liters of water consumption (energy-saving house?)
- Scratched window frames from sanding work
- Scratches on the front door
We have been trying to reach an agreement with the builder for half a year. We have tried with well over 30 emails to find a mutually satisfactory solution. The only response we always get is the same… “Your complaint will be forwarded to the responsible department…”, but apparently the processing breaks off right there.
Now it is the case that we have withheld an amount from the purchase price security, which is now held in the bank.
Deutsche Fertighaus Holding has not contacted us for 3 months and no longer responds to any emails. Since most legal protection insurances, including ours, have a new building clause and exclude legal coverage, we do not have the option to take legal action against the company without suffering financial losses. However, our insurance has provided us with a lawyer as a mediator who has attempted to mediate between us and Deutsche Fertighaus Holding. Unfortunately, there was no response to her either.
Now we do not know what to do anymore. We have set a deadline for Deutsche Fertighaus Holding by which the defects are to be rectified. Should Deutsche Fertighaus Holding fail to comply with the request to properly, professionally, permanently and in accordance with recognized rules of technology eliminate the defects or find a mutually satisfactory and final solution, we will use the amount withheld so far for the elimination of the defects by ourselves and/or a company commissioned by us.
Since the company no longer responds, we also cannot access the money withheld in the bank. The only possibility would be a waiver letter from Deutsche Fertighaus Holding. But this is exactly where the problem lies.
Maybe you have some advice for us.
