Telephone connection laid on our property without right of way

Good morning everyone,

We are currently working on the new installation of the enclosure and hedge at our property boundary. During the work, it was noticed that the neighbor's telephone line runs across our property. It runs parallel to our shared boundary at a distance of about 50 cm and goes into the neighbor's garage after about 5 meters. No right of way or similar is registered on the property.

Now my question:
Do any rights and obligations arise for the neighbor or me from this situation?

At the moment, the line does not bother me. I also think it will not be a problem in the future. However, it becomes annoying if I have to dismantle my fence or remove the planting in case of a line defect. Based on the current situation, I would assume that the neighbor has to coordinate the work with me beforehand in such a case?

Does the line belong to the neighbor? Probably rather to DTAG. Is there a reasonable reason why the line lies under your property? DTAG can of course enforce certain rights if it is acting in the public interest.

As far as I know, (DBP) Telekom asserts a right, which does not require a separate registration, to lay telephone connection lines across the entire property as soon as the owner places an order for the installation of a telephone connection; including connections for neighbors. In many areas, there are connections at or in houses to which neighbors are also connected. To my knowledge, only properties that have never had a telephone connection are exempt from this.

Or the pipe is correctly installed and your hedge is on the neighbor's property. That has happened before. Is there a boundary stone present?
