Stairs delivered without a railing and now I have to pay extra?

Hello,

we have built a house or are in the final stages. Now the staircase is being delivered. But now the company says that I did not order a railing for the stairwell (i.e., around the staircase) and that I now have to buy it separately because I did not order it (almost 2,000 euros).

Is it normal to buy a staircase without a railing? To me, that counts as a safety measure so that you cannot fall down from up there. I thought that was standard.

The contract literally states:

"Included in the standard delivery scope are the necessary stair railings with handrail (which ends at the step post), all required fasteners, and a surface treatment (clear)."

But the employee told me that by railing, they mean the railing on the stairs on which the handrail rests.

Does anyone have experience with this?

There is even a construction performance description with "stairs provided by the client" - you should have had your contract checked beforehand.

The layman might think that the parapet (is that what you mean?) is part of it. Well, remote diagnosis via forum is difficult.


I don’t know that the parapet is explicitly mentioned in our case. But for us, a move-in ready house is contractually agreed upon, which in my opinion also includes a (presumably required by building regulations) fall protection at the staircase opening.

What is agreed upon with Brandt123! we do not know. I would rather interpret the short quote above to mean that the parapet is included. Apparently, the builder sees it differently.

The construction etc. is included. Not by the client.

you don't understand, you got what was contractually agreed, what you consider standard, you should have agreed beforehand.... my example just shows that it can be worse.

I find this judgment premature (quote: "necessary stair railings are included"), I don't believe that 10/10 courts would say: it is correct that the stairwell is open and unsecured at the top. Unfortunately, that is often true enough ... Which company are you building with?
