Solar panels not available - surcharge / cancellation possible?

manomann, over 2K per kWp is outrageous (for new construction)! But then not even using the possibility to carry out leftover utilization (he is currently being thrown 300 heat pump modules) and charging you an extra fee for current modules is really crazy!

Unfortunately, I cannot contribute anything contractually. But if possible, terminate the contract because it is not fulfillable? Then commission it yourself. Should be approx. 9.9 kWp, about 1000 - max 1200€ per kWp.

Current modules at least! 330Wp (better 355Wp) with module dimensions of approx. 1.70x1.0m, 425-435Wp at 2.09x1.03m

The 2k per kwp are gross, I probably should have added that. Net we are at about 1770 per kwp.

If we use the additional KWP for 300€, we have at least slightly improved our price balance. Without the change, we are net at 1857.

He now wants to install (new):
Jinko Half-Cell Solar Module 325Wp Full Black Cheetah HC 60M-B

Is that any good? That doesn't tell me much.

Provided you signed within the period during which the offer was valid (e.g., "this offer is valid for four weeks") and the solar company has not yet carried out any work: If they offered it to you that way, they must install it that way or an equivalent alternative at the same price. A seller cannot create an offer for item A and then install item B and charge more money. If the items are not available, that is their problem since they did offer you the items; you did not explicitly ask for a specific panel. Therefore, they should install equivalent panels for the same price or, what I would try in your case to save money, you withdraw from the photovoltaic contract and look for another provider.

The problem here is that I signed with the BU. So our photovoltaic system was commissioned through the BU with the specified parameters. The BU commissioned the sub to install the system. The sub now called me directly and basically said, "either you get one module less, but it looks bad, or you pay more money and get better modules." I mean, 300€ is not a huge amount. But in principle, it’s annoying, and when/how the BU commissioned the sub, I don’t know, and it probably doesn’t concern me.

I do not know the modules. But there are as many as grains of sand, at least I know a few manufacturers that are more "reputable." A year ago, we got 345Wp modules for €224 each...

I cannot assess the legal situation regarding withdrawal and charging for services already rendered (planning services). However, I would make a friendly phone call to the construction company, asking if they would bear the remaining 50% alongside the solar installer, if you want to continue having everything from one source.
