Silent approval procedure

Hello, we submitted a building inquiry for a small hall with a horse stable (garage in the front, stable in the back, on the outskirts) to the district administration about five months ago. Twelve weeks ago, during a personal visit, we were informed that the inquiry was approved so far and that we would receive mail in the next few days. When no mail arrived after eight weeks, we went there again. Now there would be problems with the horse keeping. After discussions, the caseworker said he would talk to his boss again and that we would receive mail in the next few days. This was already 14 days ago. My question: I heard something about a silent approval procedure if the authority does not respond within three months. Can someone give me information about whether this is the case? And what should I do next?

I have not heard the term "stilles Genehmigungsverfahren"; I also can't find anything about it online. Therefore, I think you are confusing something here and mean the "vereinfachtes Genehmigungsverfahren." This must—if all required documents have been submitted—also be decided within one month in RLP.

For a building preliminary inquiry, I find no information regarding deadlines to be observed in RLP—comparable to NRW. This means in my opinion that it depends on the responsible caseworker when you receive mail.

It is different with a regular building application; here, there are indeed deadlines to be observed.

With the "silent approval procedure" it is presumably meant that the building permit is considered granted if the formal building application is not answered by the authority within a deadline. However, this does not work with a preliminary building inquiry.
