Hello!

We have purchased a plot of land in a new development area with a valid development plan. Our future neighbor has now contacted us because she would like to have a signature from us for her construction project.

As far as I am informed, this should not actually be necessary, since a release procedure should be carried out if all regulations of the development plan are met. Nevertheless, we think it’s great that we get insights into the plans and would want to do the same with our neighbors.

However, we want to avoid approving anything that could be disadvantageous to us (setback areas and much more) by signing. On the other hand, we do not want to jeopardize the contact with the neighbor by being stubborn.

What should we pay attention to before signing? (Federal state of Bavaria)

Thank you!

That really depends on what is written on the paper that you are supposed to sign. ;)

I assume you're referring to whether it says "FREISTELLER" or "Bauantrag" in bold at the top? :D I don't have the document yet, but I want to mentally prepare myself already. ;)

Even in notification procedures, one can obtain the neighbors' signatures. Then you do not have to wait 4 weeks but only 2 weeks.

I would be cautious about signing something if my signature is not necessary. What do I get out of it? Or will the neighbor pay for you an architect and a lawyer who will review and evaluate the documents?

In my opinion, this also has nothing to do with "endangering contact" or "being stubborn."

I would apply the same to myself.

You don't always have to bring out the heavy artillery or paint the devil on the wall. You look over the usually quite straightforward document and see what it's about; if there is nothing crazy in it, you sign because it will be built that way anyway, but you give your future neighbor a few weeks of waiting time – people don't usually forget the positives of that either... We had to do exactly that and were grateful to the people who signed because it shortened our construction time by 3-4 weeks.
