Several troubling contract clauses

Hello everyone,

first of all, thank you very much for your responses. I have been reading here for some time, but I did not expect so many answers, and so quickly.

I can already see from your answers that we cannot avoid a contract review by the Bauherrenschutzbund or something similar. I assume that the review by the Bauherrenschutzbund is cheaper than hiring a private lawyer, right? Is the advice comparable in quality?

It seems that the termination is standard. However, the contract states that if we terminate, we owe the company 7 percent of the house price. That the company owes us any compensation or even a finished house is not mentioned in the contract. So we need to have that corrected, preferably by someone who knows about this.

Thank you for your advice regarding joint house rights. I had the same thought. The company obviously needs unrestricted access to the construction site, but of course, that must also be granted to us. Apparently, I mixed up the terms Gu and Baufirma. And Jann St. guessed correctly. We are building in the Hannover region.

Right now, the cost breakdown is still very unclear. We have already expressed our dissatisfaction and expect a detailed and comprehensible cost breakdown of the additional items on Monday. We hope to gain more clarity about the costs and also be able to resolve the other points in the contract to the satisfaction of both parties. I will gladly provide an update then and will probably have one or two more questions.

Hello ypg, I would rather not say this here in the thread now, since this is my first post and it is immediately a bit negative for the company.

So far, we have had quite positive experience with the company (except that the planning took longer than originally planned). For example, we are truly impressed by the architect and the interior design consultant, and our sales advisor has also been diligently supporting us with advice and assistance so far. This is now the first time we have concerns, and we have not yet given the company the opportunity to explain their cost positions and possibly discuss changes to the contract with us. I would find that a bit unfair towards the company.

You can only write PMs after 150 posts. I built with a company from Burgwedel 7 years ago. That’s why. It will all work out once you have the contract reviewed and he/she will then give you tips.

So the company does not come directly from Burgwedel. Did you have a good experience with your company?

Psychologists in their practical year won’t exactly be advising you at the Bauherren-Schutzbund, and the lawyers there certainly come into contact with construction matters more than your average "general practitioner" lawyer. I assess on a case-by-case basis where you are better served professionally.
