Hi, I would temporarily support the curbstones with steel rods driven into the ground as used in gardening (always 2 per curbstone). Then knock away the concrete, place the foundation on the boundary, and build the wall on it. Cut off any protruding rod ends if they cause problems. I wouldn’t sacrifice any property for that... The premises definitely do not allow for this due to the steep slope. Sounds plausible at first, but if it were that simple...

Knock away the curbstones and then restore everything back the way it was (even if it was botched) and done. It will cost you a Saturday of work, but if you live there for the next 30 years, it doesn't really matter. I wouldn't sacrifice land for life for that, unless you have 3000m² and everything costs nothing for you, but it doesn't sound like that's the case.

As mentioned, after consulting with the garden landscaper, the curbstones are probably actually the least of the problems. There is rather a risk that the entire path will slide away there. In that case, the loss of not even 5 m² of land is actually the lesser evil.

If the neighbor unlawfully encroaches on the boundary, toleration can only become customary law after a hundred years!
However, I gladly recommend another thread from the more recent past, which also dealt with a boundary reinforcement: – but beware of equating the boundary course according to your own belief (or even according to the position of the boundary stones) with the established legal boundary course: how certain is the finding that only the stones lie on his property, and their foundation already on the property of the original poster?

Is the asshole at least the husband of the nagging wife and thus punished through the small official channel, or do you have TWO such neighbors to deal with?

or like this,
Try to hold the stones provisionally (until your foundation is finished) and then botch the stones/path back in.
Maybe not much is needed there after all.
