Restrictive building regulations, single-story construction

we have reserved a building plot. However, the building regulations are so restrictive that we simply cannot find a suitable house.

The worst is this

Single-storey construction:

In the building areas WA and MDe, the eaves height of gable roofs may be a maximum of 3.75 m, and the ridge height a maximum of 9.00 m above the normal height.

The eaves height of shed roofs (lower horizontal roof edge) may be a maximum of 5.00 m, and the ridge height (higher horizontal edge) a maximum of 7.00 m above the normal height.

For shed roofs with a staggered upper floor, the height of the horizontal roof surface (roof terrace) may be a maximum of 3.25 m above the normal height. Solid parapets as a limit above this height are not permitted.

The roof tiles may only be matte, red clay tiles.

Do you have similar requirements or is this really just a special case here? We also need space for 3 children. Best regards, Sandra

Hello Sandra,

it is really frustrating when you have found a plot of land and then cannot build on it the way you imagine.

Such development plans, however, are not unusual. I personally also hold the opinion that my house has to please me and not the city / municipality, therefore I think you will have no other choice but to look for another plot on which your ideas can be realized.

An alternative would of course be to ask the responsible building authority about the chances of getting an exceptional permit...

Have you ever looked for gaps in older building areas? We are currently building on a street where all houses were built between 1950 and 1955. There is no such strict development plan here - we only had to orient ourselves according to the surrounding buildings (§34)...

No tent roofs... only half-hipped roofs anymore :(

I googled myself using your information and found the development plan.

Is this now the plot near the horse paddocks?

I understood that this plot is not an option for exactly this reason, even if you had the possibility to build a staggered shed roof...

It’s really annoying! An affordable plot isn’t exactly easy to find every day – you have to make so many compromises when building. You somewhat “willingly” do that too. But you also want to like the house and its surroundings ;)

In your favored town, there are other residential areas. The development plan there is apparently not enforced as strictly.

Height alone is not the limiting factor, but can only lead to the (subjective) restriction that space is not enough in connection with a narrow building plot. If that is actually the case, you should still have money left for more living space and a larger plot!?

Other alternatives are, as already mentioned, gaps in the building structure or objects suitable for renovation in the existing stock, specifically for tinkerers in areas where there is no zoning plan. However, I would build with an architect there, because you can often get a lot out of individual ideas. But there are conditions there as well.

By the way, I don't find the requirements so dramatic and if there were no requirements, everyone would build however they felt like. I leave it to your imagination how that would look...
