Price increase after order confirmation / contract conclusion

Hello everyone,

Based on the offer, we concluded a contract at the end of March (written confirmation of order amount and items) which was signed by both parties and is in our possession.
Now we should sign an additional addendum stating that raw material prices have increased and the additional costs (not quantified!) will be passed on to us.
We have not and will not sign that, as no framework has been set.
Does anyone have experience with how the legal side behaves? I mean, I understand if the contract was signed 6 months ago or longer, but just under 6 weeks.
He is supposed to provide by the end of next week how much the price increase is and then we will talk again, but fundamentally, in my opinion, a contract is binding.
Price reductions would also not be passed on to us.
Of course, we canceled other companies after signing the contract, and we won't get a replacement that quickly!

It entirely depends on what is stated in your contract. If in doubt, have it reviewed by a lawyer!

Moreover, this should be a warning shot for anyone planning to build within the next 2 years. The scarcity of some building materials not only causes the material prices to skyrocket but can also lead to serious delays in construction progress. Therefore, it's better to calculate a proper buffer and not "push the whole structure to the limit."

The contract contains nothing regarding price increases etc. or there is no clause or the like.

Then don't sign anything, and if they become difficult, as already said, consult a lawyer. It would be interesting to know whether (and which) of the developers has given/concluded a completion guarantee. Because if they pull out in the middle of construction, since you have calculated too tightly after all, you haven't gained anything either. Finding someone to finish a partially completed building is probably very, very difficult.

If it starts off like this, prepare for expensive surcharges on sample markings. Hope your [Bauleistungsbeschreibung] is already sufficiently comprehensive

Crazy what's going on at the moment. Unbelievable...

I wouldn't sign anything either. But of course, it doesn't help you if they go bankrupt due to miscalculations during the construction phase...
