You keep the 5% until the end of the warranty period to ensure that you have money for warranty cases in case the company no longer exists by then. An alternative would be a warranty bond. We had received a completion bond and a warranty bond.

Is that fixed or does it have to be negotiated? Because I haven’t seen that in our contract so far.

I think you have to negotiate that separately, or am I mistaken? A general contractor probably won’t offer that on their own, since they want their money as quickly as possible (even if they cheat)...

For me, this is the wording originally posted, right? Then that is already good. However, nothing is mentioned about the duration of the security deposit, i.e., nothing about the warranty period or 5 years.

Don’t hold me to it, in our case the developer actually formed a new GmbH specifically for several properties. He brought it up openly, we didn’t care either. We promptly paid the 3 or 5% to be registered as owners in the land register. Towards the end I was afraid that the GmbH “could” go under. Of course it didn’t, but I don’t know what would have happened with a priority notice of conveyance and insolvency of the developer.

I am hearing about this withholding for the first time. For my understanding: I pay 5% of the construction costs (e.g., €25k for a house costing €500k) at some point during the construction phase into a security account. The money is parked there until it is released to the contractor after 5 years. Correct?
What does an option with a guarantee look like?
