Place the house and garage in the middle of the property?

Hello everyone,

we are currently planning our house. We would very much like to have a covered garage. However, this roof would have an overhang. Since we do not have any neighbors to ask if we can "only" move one meter away from the boundary with the entire construction to build a covered garage, we would now have to move 3 meters away from the boundary. I think that is a lot.
Would you do that? I don’t know if it looks stupid when everything is in the middle. There would actually be enough space

What do you mean by a covered garage? Normally, you are allowed to place a garage like the one in the picture on the boundary. The only condition is that the gutter of the garage must still be on your side. Unless the development plan specifies otherwise.

I do not understand the question or rather, whether a boundary construction is permissible or approval-free in Lower Saxony.

For Lower Saxony, the answer is yes, as long as the total length of 15 m is not exceeded:

§ 5 (8) sentence 3 Lower Saxony Building Code:
"Structural installations according to sentence 2 may fall below the distance according to paragraph 2 along a total length of 9 m per property boundary, but on a building plot only up to a length of 15 m in total."

Edit: According to § 5 (8) of the Lower Saxony Building Code, there is a height restriction of max. 3m (but presumably only within the otherwise restricted areas).

As a precaution: And if an apartment (or something similar or a balcony) is to be added on the roof of the garage, the boundary construction will also not work, because then the "garage" will no longer be a garage (on top) and will immediately lose its privilege as an exception to boundary construction due to the "apartment"...

You will have a neighbor, but presumably that is the city/municipality, right?

Based on the information, it cannot be conclusively assessed from here, but if the statement comes from your planner, they are probably correct. There can be various reasons: building envelope (designation in the development plan for ancillary buildings), size of the garage, assessment in connection with the ancillary rooms, roof pitch...

Basically, in my opinion, it doesn’t look bad; if you can come to terms with the central location on the property, it might not be worth the effort to clash with the building authority.

The other option is also possible in NDS, then the planner just has to reflect a bit more and get out what’s possible.

In NRW (explicitly not the same legal situation as in NDS!) garage roofs idR with up to 30% pitch do not count towards the wall height and may therefore be built on the boundary.
