Online apartment sale, what can be shared

Hello,

this is about a condominium that is listed for sale on the online portals and is known to me. All documents were sent to me by email, including the latest statement from the owners' association.

It also includes the name and address of the owner who apparently rented out the said apartment most recently.

Is it customary that this personal information may be sent to every interested party upon first contact (email)?

That should be in the WEG, the Condominium Act, at least indirectly. The WEG regulates a lot, more than some "out here" outside the community of owners can imagine. Everything requires form, and yes, there are also, for example, names of the owners shown for the minutes of the meeting. And the minutes are of course accessible with real names.


I assume the management is offering the apartment? … Whether that is common is irrelevant. The question is whether it is legitimate. I don’t know, but I can imagine (see above). But honestly? If it is as you described, then I would find it not common to make a fuss about it and spend time on the question. Especially if it is an error of the sender. Mistakes can happen! And mistakes are best passed on to those who made them and kept quiet towards others. If it bothers you that much, then call the sender and tell him that he may have made a mistake regarding data protection. Most likely you will then be informed whether it is permitted. Yes, it's quite normal. I've never seen it any other way in purchases and sales. Whether private or through an agent. The seller usually agrees in the agency contract that ALL information about the property is passed on.

I had forgotten to mention that the offer came from a female real estate agent. I knew the current owner because she had bought the apartment from me back then. I happened to find my ex-apartment on the portals.

If I were a real estate agent, I would obscure the owner's name on the service charge statement. Because every time an inquiry is made to the real estate agent, the owner's name along with the address is passed on.

Germany is usually so particular about data protection, it just surprises me.

ypg, do you have to add your two cents to everything or are you the moderator here?

I give my opinion and my expertise where I want. It’s not my fault if you ask the general forum and you possibly don’t like the answers or the respondents. And yes, I was once a moderator, but I gave it up for various reasons, including, among other things, because some TEs got too personal for me.

It may be customary, but it is unlawful without consent. However, since the owner also becomes the seller, the broker will have secured themselves with the appropriate forms and obtained the consent accordingly.
