Obligation to develop the plot within 2 years - experiences?

Hello,

we are about to buy a plot of land designated as building land for which a positive preliminary building permit exists.

Regarding the question:

The plot was acquired by a real estate company X from the city, divided into 5 parts, developed, and is now being resold.

The draft purchase contract includes an obligation to build a single-family house within 2 years. No further explanations ... no clauses.

We want to build, but if something comes up (illness, work, etc.), what legal consequences do we face? A return to the city, to the real estate company? And if so, at what price? Penalty payment..? Does anyone have experience with this?

One more question, we have to grant a right of way, literally „
a protection strip of 1.00 m to the right and left of the centerline of the pipeline must be observed, on which, for the duration of the pipeline's existence, no buildings or other impacts (planting of large greenery) that impair or endanger the existence or operation of the facility may be made.“

Is a fence + hedge basically still possible in this area?

This is actually included in the notarized purchase contract. The rescission of the contract is not uncommon.

Shallow-rooted plants should not be a problem. A fence with foundations will certainly be more difficult. In the end, only the authorized person / the municipality can answer that for you. We also have such power lines for street lighting. The municipality has informed us that an enclosure is generally not a problem; they just want to be notified in advance about when, where, and exactly what we want to put there and then coordinate with us about what is allowed.

Ok, thanks.. unfortunately there is nothing about the building obligation in the draft purchase agreement, hence my question here.

Yes, the line practically crosses the property in the back, we actually wanted to put at least a panel fence on the left and right.. to the respective neighbors..

If you know exactly where the line is, you can set the foundations exactly 1m away from the line and the panel goes over it. Such a panel is 200 or 250cm long.

Is there already a reason why you don't want to start building immediately? There is definitely a developer tie-in with the [Grundstück].

No, there is no reason, we want to start in 2019, there is no developer restriction..

I just keep thinking a lot about what if, illness, accident, work.. when you might still pull the emergency brake and not build, just wanted to know what to expect then.. maybe a question for the responsible notary..
