No fire protection door to the garage - whose fault?

Good morning,

we have built a house and during the structural inspection by the building authority, the lady noticed a week ago that the door to the garage is not a T30 fire protection door, but a "normal" secondary entrance door.

The building permit also states that a fire protection door must be installed there. The house construction company also has this building permit. (Since the beginning of the planning phase)

Now they told me that I signed all the execution plans before the start of construction and therefore have to cover the costs myself. That means I now have to buy and have a new door installed myself.

But as a layperson, I do not notice such details at all. Does anyone have similar experiences or advice?

why does there even have to be a fire protection door? is the fire protection door mentioned anywhere within the scope of your contract, or is the building permit part of your contract?! any signatures on execution plans do not exempt specialist companies from complying with applicable laws and so on. if the building permit is a fixed part of your contract, it might still be possible to achieve something there. but as always, it will be difficult and is not a simple matter without a lawyer and so on. otherwise, you could of course also criticize the defect-free status during the final inspection (no acceptance by the building authority). if the permit is included, I would now speak reasonably with the construction company and look for a reasonable, amicable solution. possibly the costs can be halved or otherwise kept low. if the permit is not part of the contract, you are probably out of luck. otherwise, a lawyer can surely help you more if you want to know for sure now. otherwise, you would have to provide much more information. for example, the clause in the contract, developer, contractor, reason for fire protection door, etc... maybe the fire protection door can also be removed?!

Who are 'they'? So who said that?
What is stated in the execution plans?
Are you building with a general contractor, i.e., a site manager?
Is it possible that it is a temporary door?
What was commissioned from whom?

In my humble opinion, the buyer/client does not assume any substantive liability by signing plans. As a layperson, you cannot see everything clearly. Therefore, the statement from the construction company is IMHO at first just an empty threat. (It may be that in the end you are still the one who gets the short end of the stick; we’ll see).

Questions:
1. Can you upload the signed plan (excerpt) here? Was it clear from the plan that no fire protection door was planned there?
2. What does your contract say?

Can it be that the lady from the building authority says: possibly has not seen a steel door and does not know that fire protection doors can also look like regular doors. Inform yourself with the person who installed the door.

thank you very much already! In the building permit from the building authority, the construction application from the architect was handwrittenly changed by the building authority employee. Namely, that at the bottom there must be a T30 fire protection door to the garage. The house company told me that they basically do not supply anything like that.

I will gladly put the passage here. Later.

There are already new problems with them again.
