No, I don't think so, as the obligation to tolerate the right of way is included in the purchase contracts. Only the registration itself seems to be missing. Armed with the purchase contract, registration would be possible at any time, A has already agreed with the purchase.

Basically yes. It would be stupid if A had sold to D in the meantime - there is no contract between Alt-B or Neu-B and D, and he bought property A in good faith.

A clause in A's purchase agreement that he must also transfer the following obligations to subsequent buyers could also regulate this. We have such passages in the property purchase agreement.

We could tell you a (our) horror story with exactly the same topic, but with a sad and very expensive outcome..... we are moving out again now...... Your costs will be less than our postage costs.
I understand that one is frightened at first, but already when I saw the garden access I was more reassured. For us, suddenly both were gone, zero access, the responsible notary has long been dead, everyone else just shrugged, even the authorities.
Another person involved here apparently lost 20kg and got gray hair, luckily we found our own positive curve and are now looking forward to the new building. But I don’t have to tell you about our feelings over the last 8 months when suddenly the balloon bursts....
So..... don’t be annoyed but be glad that it’s not stomach ulcers and/or 120,000 euros or similar. You can live there, you apparently have a great neighbor whom you should actually be grateful to. This neighbor could rightly say that he bought his property WITHOUT this new right of way and suddenly the trouble would be there and lifelong bad neighbor relations, which is not uncommon in such cases.
Open a bottle of champagne and be happy - we are!
