Material paid to the craftsman - am I now the owner?

Hello,

I paid in advance about 5,000 for material after consulting with the dealer. The invoice came from the craftsman, and I transferred the money directly to him. Contact has been slow for 3 weeks about when he will install the stuff. The material is with the dealer.

Yesterday I was at the dealer and managed to get him to deliver to us today and put the material in my yard. He said that the craftsman normally always orders and pays in cash. However, they only have a short history together.

Of course, I hope that the material will be delivered today.

How does it look legally if the stuff is with me, is it my property since I paid the craftsman?

What about the installation? Can I withdraw from it or do I have to set a deadline?

Not so nice at all and no, I don’t want to send my Serbian family away.

If you have paid the dealer directly, this is generally a sign that the material may have become your property. However, it also depends on what you intended with your direct payment, that is, what the content of your declarations of intent was. In the event of a dispute, you will need a lawyer and a district court for clarification. From the shipyard business, I actually know that in such cases the customer marks all already paid material as their property – if a shipyard needs customer assistance with purchasing, it is usually on the brink of insolvency.

If it is delivered to you and is at your place, you are initially in a good situation. I would put it aside so that he cannot access it, if possible. I mean that he cannot simply take it away, but he is allowed to install it.

How it stands legally is another question ...

Invoice is there, material is there, money has flowed, material is with you! All good, I would say: owner is also proprietor ;)

I think so too. He should just install it. However, there was a little discussion about prepayment and now we are waiting for something to happen..
