Massive problems with the builder - is contract termination possible?

Well, the delays were not caused by us. We waited many weeks for information from the basement (and are still waiting for a breakdown of the costs). And that the living space has now become so small was only noticed in the building application. According to the offer (with 30 cm bricks) it was about 143 sqm. If we stop now, the developer said he would prioritize other customers and we would only start in June/July. Probably just a threat. Great business relationship...

I always try to understand the arguments of both sides. HOWEVER - to find out already at the beginning and especially before signing the contract that the hopes regarding the client ./. provider relationship will not be fulfilled, that they are already obviously disturbed, does not, in my view, form a basis for a smooth construction process.

The construction industry is booming, no question; therefore I understand that your provider wants to prioritize other construction projects and do not consider this a empty threat in this context; rather a necessity. On the other hand, I do not understand that you, in such a - still - uncertain contractual relationship, have no time to possibly wait 3-4 months. You will - hopefully - live in the house for many years, so it should not fail because of a later construction start. Clear contractual relationships form the be-all and end-all of a construction project!

Yes, a personal conversation was declined by the developer, even by the managing director.

Since nothing has been signed yet anyway, I would pull the emergency brake at the latest now and look for another contracting party.

Well, the construction contract has already been signed, so it's hard for me to get out of it.

Just to make sure I understand correctly:

There is a construction contract (already signed) and a work contract (not yet signed) at issue here.

Why are there two contracts?

What is regulated in the already signed construction contract?
