Hello,
Is there a legal deadline for processing a building application? We submitted our building application in week 37. It was returned after 2 weeks because, for example, we did not indicate where the garbage bins should be placed or where green areas should be on our property later. After all "errors" were corrected, it was sent back to the building authority. We are now in week 46 and still have not received anything back.
If I understand you correctly, your building application has had an actual processing time of 5 - 6 weeks so far?
Most construction projects, especially residential buildings and garages, fall under the "simplified approval procedure." In this procedure, the review is
only limited to compliance with the most important public-law regulations. Thus, only the planning law admissibility and essential building code requirements, such as parking spaces and setback areas, are examined. Approval for this is usually granted within 4-6 weeks; often unnoticed by the applicants if the architect has not marked a "notification field" on the building application.
Then there is the "regular approval procedure." This is the "most comprehensive" building permit procedure. It is carried out for the construction and modification of projects, facilities, and installations that are subject to special requirements. In this procedure, the authority examines compliance with
all public-law building regulations. The issuance of a building permit in the case of a "regular approval procedure" can take up to 3 months or longer.
