Local heating contract and boundary construction

Hello house building forum,

I have two more questions for you:
1. Local heating contract conditions:

    [*
      In the new development area there is a contractually mandated "connection and usage obligation" for the local heating network, but with unsatisfactory conditions
      [*]The contract includes the following additions:
      [LIST]
      [*]...an exemption can be granted upon application if a building is constructed that meets at least the requirements of a "KfW Efficiency House 40plus." The exemption must be applied for in writing.
      [*]In case of violation, a penalty payment of a one-time 50 euros per square meter of living space or heated usable area is set....


To me, this reads as if the local heating connection obligation can also be circumvented by the two exceptions mentioned above. Ultimately it also depends on whether a KfW 40plus really pays off and what the additional costs are.
The second option would be to accept the one-time penalty payment. At the fixed 50 €/sqm (approx. 160 sqm heated area), this would be more economical over > 15 years than using the local heating under the given conditions and you would be independent of price increases in the long term.

Do you understand it the same way?


2. Boundary construction

      In the building area boundary construction is completely permitted (due to the lot size). The neighbor’s house will therefore directly border on our garage. I know from the neighbor that he wants to build with a basement, which is OK. However, this means he has to make a slope for the excavation on my property. If the foundation for the garage from my side is already built by then, that is no longer possible...

      [*]How do you see this and what options are there?
      [*]Maybe plan so that he at least finishes the basement shell and floor slab early, and our garage foundation is built only afterwards? Otherwise we would be completely dependent on the timing.

Regarding 1, I understand it the same way, but better calculate precisely before you risk any penalties. Tendentially, I consider it unlikely that only district heating will become more expensive and electricity not.

Regarding 2: If you can schedule it so that the basement is built first and then construction continues from the ground floor, I would do it that way. Otherwise, your ground must be supported when the basement is being built, which is also possible but always associated with risks. Also, rumor has it that not every builder takes the necessary measures that strictly...

hm… we used to have district heating in our townhouse estate as well. We were actually never significantly more expensive than colleagues/friends using other media. We never needed a chimney sweep either.. ;) How would you want to heat alternatively?

In our case, it is even very specifically defined how the price is calculated. The provider (Stadtwerke) cannot simply impose surcharges at their discretion.

Regarding district heating: One-time connection costs to the district heating network: €10,000 And the prices for the next 20 years are fixed as follows: Basic price for maintenance and inspection: €650 / year Labor price: 8.2 ct/kWh Operating costs per year are estimated at €1,850 for heating and domestic hot water. (Assuming a total consumption of 15,000 kWh) Seems high to me compared to an air-to-water heat pump.

The compulsory district heating will also have something to do with wanting to save individual house heating rooms. Presumably, the municipal council pondered for a long time on how to manage, in practice, to place a single-family house on mini-plots at all.
