Hello everyone,

I am interested in your experiences and how you have come to agreements.

The following:

1.)
My partner (we are unmarried) with two children owns a plot of land on which we want to build a house.
I bring a daughter into the relationship.
Since the plot belongs to her and has currently appreciated significantly in value, this would have to be calculated out of the inheritance for my daughter.
We simply want to avoid disputes in advance and are therefore looking for ideas for an amicable solution.

2.)
How does it work with the construction loan?
If we separate (which, of course, we do not hope for), how can I protect myself regarding this matter?

I would be very grateful for constructive suggestions!

Unfortunately, I don't have time for a long answer.

You are not married, so nothing will be inherited by the "other" children anyway. Only the shares of the house and the land will be inherited according to the division in the land register. So don't just build a house on her land, because then it doesn't belong to you and your own child won't inherit anything; your partner's children will inherit the entire house with the land. If you are not listed in the land register, of course you also won't take out a loan in your name.

Furthermore, be sure to draw up a will.

Mmm...my layman's opinion...the easiest would be for you to buy half from her, so everything could stay normal in the estate. You also wouldn't have a problem with the house to be built on it then. Because that belongs to the property...you can search for Pianist in the forum...he has a thread about a house on the parents' property. Everything else is surely the much more complicated way.

If you co-finance a house that stands on a piece of land which belongs to [100%] to her, you acquire [€0.0] ownership in it. Your daughter doesn’t either because she is unmarried.

Why shouldn't your daughter get anything? How old is she? If you are a family and you die in 20 years, it wouldn't be very nice if her children get everything and your daughter nothing...

No matter what could come from us, this is a matter for a family notary (or whatever they are called, I once knew one who called himself that). The matter is quite complex.
