Regarding the garage: Would it be conceivable to commit oneself to dismantling the garage at one's own expense in a timely manner should it be required, for example, for a highway expansion or something similar?
Can the garage be built in such a way that the tree population is not disturbed?
Those are exactly my thoughts on the matter. The tree population on "my" property is zero. The trees are located on the earth embankment up to the highway and have grown on the highway’s land.
Especially with a garage, I see the "demolition requirement" as unproblematic for me personally, since I only want a "cheap garage" anyway. A simple metal shed where my car is protected is sufficient (although it is supposed to be 9x9m in size and have a certain height).
Ideally, the garage is a kit that could be rebuilt elsewhere if necessary.
Have you already had the chance to ask the neighbor to the north?
Unfortunately not yet, however, after reviewing the 30-year-old documents related to the granting of his garage’s building permit, the northern neighbor was not within the 40m zone at the time. Only today has the zone moved closer to him, and thus the garage is now partly within the zone.
But I have another neighbor who recently built a triple garage directly next to the noise barrier; I will get in touch with him when I am back on site.
PS: I have an appointment tomorrow with a lawyer specializing in public construction law. I hope he can assist me with wording and advice.
