Is the price difference between Poroton and aerated concrete justified?

Hello everyone,

I have a quick question regarding the price of Poroton and aerated concrete.
The background is that our architect made a "small" mistake in the description of the interior walls in the specification.
He accidentally requested Plan-Hochlochziegel instead of aerated concrete (supply and professional installation). Unfortunately, this was only noticed afterwards, once the contract had already been awarded. The shell builder has now sent an additional charge, and the aerated concrete is supposed to be over 30% more expensive per m² net. (24 cm Hochlochziegel = 49.22 Euro/m² and aerated concrete = 65.29 Euro/m²). The same applies to the 17.5 cm "stone" – brick = 37.82 Euro/m² and aerated concrete = 49.40 Euro/m²).
Are these prices acceptable or common, or am I being "ripped off" here?

What difference does it make whether the prices are realistic or you are "being asked to pay," since the contract with the structural contractor has already been awarded ... probably with corresponding clauses in case of unilateral contract termination?

Since the root cause of the problem - according to your description - lies with your architect, I would suggest you send him into the price negotiations race.

in principle, you are right, but what if the architect says that the prices are realistic?

It is wise to know in advance of such negotiations whether the price is realistic or not!

Unfortunately, I cannot provide any information on the core issue!

Exactly that is the reason why I am asking - I will certainly send the architect into the race and of course I asked him yesterday by email for his opinion on the prices -> reaction is still pending. But what good is all that to me if he now says: "Price is O.K."!? Against this background, I wanted to ask for a second assessment here from the forum...

@construction expert And no, there are no clauses for unilateral contract termination. The contract comes from "us" and not from the shell builder himself and is thus written in a way that favors the client. We could theoretically terminate the contract without any penalties (which you probably meant) if we wanted to. Whether this will still be done at this stage is of course another matter...

Well, every change of the representative usually costs, at least almost always. I see it as a construction expert, and it hardly matters what is realistic. Craftsmen charge for switching from aerated concrete to Poroton and from Poroton to aerated concrete, that's just how it is.

I can hardly imagine that, because one-sided preferential treatment is unlawful and thus voidable; but since you write it...

From my point of view, there is only the possibility that you have already initiated; namely sending the architect as a mediator into the talks. The shell builder will incur costs due to the change of the bill of quantities and he understandably wants these settled; in my opinion, this has nothing to do with whether the hollow bricks are offered cheaper/more expensive or at the same price as aerated concrete.

Whether you - if the shell builder shows no willingness to compromise - terminate the contract is up to you to decide. Regarding the timing of the construction measure - we are three weeks before Christmas and thus the usual company holidays - in my opinion, it does not matter.
