Is garage boundary construction possible?

Good day,

we want to build a single-family house with a double garage soon. The garage is to be built as a flat roof and as a boundary development to the neighboring property. There are a few requirements that must be met, does anyone know these (Landkreis Niedersachsen)?

Now my question is, do we need the consent of the neighbor or can it still be built there if the garage meets the requirements?

3m height and not countries as 9m per property boundary.

Hello,

I am using this thread now because it partially applies to us (also Lower Saxony).

How is the situation if there is already a fence on the property boundary? We want to build in the rear development and between the properties there is currently a hedge (on our side) and a fence, which according to the principle of legal enclosure belongs to the neighbor. Now, in the course of the property division, the boundary stones were uncovered and it appears that the fence is exactly on the property boundary. Can we still place our garage on the property boundary? What options do we have? Building application has not yet been submitted.

We should know that more precisely. Is the fence on the boundary or not?
In general, you can tear it down and put a garage on the boundary.
Here the lines between private and public law blur.
Public law only regulates which structures are permitted on the property boundary. The private ownership relationships are not considered by the various state building codes.

Are you concerned about the ownership relationships or what is permitted on the boundary?
