Is construction pre-planning without signature / contract legally valid?

So you gave your architect a prospective commission, but expect a finished design with a performance specification from him?



This is probably what is called a "PRELIMINARY DRAFT" or "CONCEPT DESIGN." It often looks like a simple line drawing and doesn’t really allow for a detailed construction description yet.
What did you expect from him?

Yes, I think it was a preliminary draft and it is legitimate not to like it and to end the started collaboration due to a lack of communication. Or?

Of course, it is legitimate to terminate the collaboration if you are not satisfied.
But the question is: what about the service provided up to this point?
That must be compensated, the architect does not work for free!
Service phase 1 according to HOAI = basic evaluation
Service phase 2 according to HOAI = preliminary design (rough sketches!) and initial cost estimate
He has delivered that according to your statements, hasn’t he? You have received a preliminary draft and a cost estimate, haven’t you!?
As a construction expert, I see little chance of getting out of this situation.
You should try to settle amicably with the architect!

this is the problem that all architects have to deal with.
It's just a few lines, and I don't even like them. Why should I pay?

If you don't like a treatment by a doctor, do you think he won't charge you anyway? If you don't like information from a lawyer, do you think he won't charge you anyway?

I stand by it: 1. The performance must be evident; if it's nonsense, there is no expensive money 2. One should at least discuss that a preliminary draft also costs something and if so, how much 3. Coming directly with a lawyer is improper! That's not how it's done; you first establish personal contact
