Yosan, are you 1000% sure that you would have been able to get out of your contract without any problems if the property or financing didn't work out? Has this been reviewed and confirmed by a lawyer? Laypeople often find it difficult to recognize the hurdles and pitfalls of legal German and to properly assess whether, for example, the home builder is also not allowed to arrange a lender, even if the installment might then not meet the borrower's expectations.

I am sure, as we said, that we had the specific property as a condition... since it belongs to friends of ours who would have registered personal use for their son as a reason not to sell if necessary, it would have worked in our case... regarding the financing alone, there is certainly a loophole as you write, which is why that alone would not have been enough for me. I definitely do not advise such a thing... only under certain circumstances is it not necessarily wrong. In any case, everything went well for us in this regard :-)
