Help with interpreting the development plan

Hello.

We recently purchased a building plot and now want to build the largest possible multi-family house on it. It is an old development area, but a zoning plan exists with only a few regulations. The terrain slopes downward from the street. As I interpret it, the 2 full stories refer to the street view, and due to the slope, there can be more towards the garden side, or am I misreading the plan? I think this because the building is divided in the middle and colored differently, and the symbol for the maximum number of full stories only appears on the half facing the street.

Therefore, just as a very rough sketch, a question to you whether something like the rough sketch would be possible there with regard to the zoning plan.

And regarding the 8m to the left of the building, does this mean I have to keep an 8m distance from the neighboring boundary with the residential building?

For the correct interpretation, the legend of the development plan would be very helpful. At that time, the representation of the building structures was usually included in the plan as a non-binding building proposal. The centerline is intended to indicate or determine the ridge direction (see legend or written determinations). The full floor count does not refer to parts of a building, but to the entire building and is regulated by the state building code. Whether the state building code valid today or at the time the development plan was established is to be applied is disputed among experts. Mostly, the "static" view is held, that is, the application of the state building code valid at the date of the development plan. Unfortunately, your rough sketch is not interpretable. Where is the terrain supposed to run now? What is located below your lowest floor? According to today's state building code, you must dig the basement so far into the ground that it protrudes less than 1.40 m on average from the ground. For example, if you plan a basement height of 2.80 m towards the garden, the terrain profile in the side view should not lie below the diagonal. That's how I would see it. But discuss everything with the office to find out whether they still want to adhere to such an old development plan at all. They will also explain the correct interpretations of the plan symbols to you.

With such old things, it is always easiest to stop by the responsible building authority and simply ask directly what the municipality can imagine. Often there are binding exceptions that would also apply to you.

Thank you very much for the many responses.

I was also at the building authority today at noon, and he said roughly the same as you here. That the 2 full floors refer to the entire building. Well then it will probably be 5 apartments. In the basement 1 apartment on the garden side and in the earth area the cellar rooms and technical rooms. On the ground floor and attic floor 2 apartments each.

We are building to bring our family together and if 1-2 apartments remain free, to rent them out. We just think that if you already need a roof, it doesn’t cost much more whether it’s for 1 or several apartments. My wife and I earn well and are not building to make money. We rather think what you have, you have.
