Height difference of the neighboring driveway - who pays?

Hello, I am new here and have a question. We have built a house and will move in at the beginning of August. Next to us, a prefabricated house was built. The plots have a slight slope, so our house sits lower than the neighbors'. The neighbors had a huge amount of recycled construction waste dumped for their driveway. As a result, we are now even lower, but that would not be a problem. The problem is the earthworks contractor, who in my opinion neither has the time nor the desire to do their driveway. For the garage, L-bricks were set, but only halfway, because the earthworks contractor first wants to wait and see how we reinforce our plot. I don't understand why we should reinforce our plot when the neighbor is higher than we are and it is about their driveway. After all, they need the edging for their driveway; we only want to plant bushes. Could someone perhaps help me and tell me who has to cover the costs for the reinforcement? Our terrain used to flow seamlessly into each other; due to the fill, there is now this offset that goes from zero at the street to about 50 cm. Thanks for your answers.

If you do not pile up, the neighbor must ensure that his land does not slide onto your property. The same applies if he had built deeper. Since he builds after you, he must take care of it. As a compromise, a joint solution can be devised where each party participates. This can be good for the future neighborhood.

Normally, the building authority sets a height, right? You can’t just pile up soil or quickly raise the driveway. I would ask my responsible building authority what they think about it. Normally, the person who builds higher has to secure downwards, especially if they have piled up soil and thereby changed the ground level. In our building application, a site plan was mandatory – all heights are basically fixed there. If the two site plans (your neighbor’s and yours) differ at the boundary, the building authority has been asleep.

But not for driveway height... This results indirectly from the building/garage height approved by the building authority.

Otherwise: whoever builds higher must secure it.

Of course - in the open space plan, all heights are listed - also along a driveway - at all property boundaries (so that one knows at which level one plans to connect to the neighbor). At least that is how it is with us.

Hello, first of all thank you for your answers. Our plots were a meadow, the border went straight across without a step. But since the terrain has a slope, we lie lower. And since the neighbor has built up his driveway, there is now an offset. The construction debris still lies up to our house and the builders are not making any efforts to have it removed, although it was agreed that the construction debris on our side must be removed. For their prefabricated house they needed a certain width for the crane.
