Garage on boundary exceeding 3 meters by ground filling

Hello. The following issue: Garage built on the boundary at 6 meters. Garage 2.81m high on the boundary. The property has a height difference from front to back of 1.10 meters. The garage and the gate should of course be level. Accordingly, we want to fill sand at the front, with the concrete slab we reach a height of 80cm. Then the garage with 281cm will be added. So 361cm. Is that allowed on the boundary? The building itself is not higher than 3 meters. Just so you know. Unfortunately, our builder is unsure. The topic only came up today after everything had already closed.

That depends on where the measurement is taken from ... for us it was not the original ground level but the street, but that might be different in your development plan

What do you mean by the street? You mean the boundary to the street then?

Is that a neighbor boundary? We had the same issue in the building area, it was rejected by the building authority. The reference point was the original ground.

I will take another look at the development plan later. I don't think it says anything about that. A few houses down, someone has placed their carport on the boundary and filled underneath it. As a result, it has a height of 335cm. By the way, we are located in Niedersachsen.

The garage is on the boundary to the neighboring property. It is 3 meters away from the street. These 3 meters will also be raised by 80cm. At the street, it will then be 60cm higher than the street. We will install natural stone there.

Unless the development plan specifies a terrain height, which by the way is very rare, the natural ground surface applies. Your garage would then not be permitted as is.
