Hello everyone,

according to neighborhood law and building regulations of the state of Brandenburg, a garage at the boundary of a property may be a maximum of 3m high.
In the case that I have a gable or hipped roof, where is the measurement taken then? Directly at the property boundary to the neighbor or generally the highest point of the garage?
Does anyone happen to know this or perhaps has experience with it?
We are planning a garage with one of the two above-mentioned roof types, as a "normal" roof does not appeal to us that much.

In our building application, the average height of the garage wall is calculated, and it must not exceed 3m (NRW). The measurement is taken where the garage has the highest and lowest point within the 3m limit (from the natural ground level). As far as I know, the roof does not matter, since only the wall height was mentioned. But I cannot make a 100% statement about this, as we have planned a flat roof.

It also depends on the roof pitch in NRW. As a rule, the garage is built as a flat roof, then the wall height applies. Regarding the wall height, for example in NRW, depending on the roof pitch, a portion is added or not (the threshold in NRW is iirc at 30° roof pitch).

: ask your architect about this, he should be familiar with the regulations in BB; if necessary, it is stated in the Landesbauordnung BB, but possibly also in the stipulations of the development plan, if there is one. It may be that the development plan contradicts the state regulations, i.e., then what is stated in the development plan applies and not what is in the Landesbauordnung,

But your architect knows and checks all this in 5 minutes.

Regarding height, the basic rule is: it always refers to the original ground level of the building plot at the boundary. Therefore, height measurements must be taken BEFORE the first groundbreaking to provide proof, so there will be no hassle afterwards.

If building is done first and measurements taken afterward, it becomes difficult.
