Garage - Building Application - Confusion

Hello,

we have submitted our building application for our single-family house with a ( separate ) double garage ( 5.85m x 8.94m ).

The double garage is made of steel panel construction, so a prefabricated steel garage.
State: Brandenburg.

The garage is supposed to stand with one side ( 8.94m ) on the property boundary.

The problem now is that according to the Brandenburg Garage Ordinance this wall ( party wall ) must be a fire wall !!
Which is not the case with our prefabricated steel garage.
At least this is what our officer at the building regulations office is now complaining about....

The garage company has already built several of these garages, also nearby, and hears about this problem for the first time.

The other customers never included their garage in the building application process and therefore never had problems here.

Now my question is, can that be true?
What should I do?
"Upgrade" one wall to a fire wall - apparently a 24cm thick wall is needed.
Remove the garage from the building application and then simply have it built later?
Because, as far as I know, the garage is actually exempt from approval.

Has anyone ever had similar problems?

Brandenburg Building Code:

(1) Firewalls are room-enclosing building elements for the termination of buildings or building sections. Firewalls must be continuous and aligned in all floors. Firewalls must consist of non-combustible building materials and be fire-resistant even under additional mechanical stress.

(2) Firewalls must be constructed

[*]as party walls (§§ 16 to 19 of the Brandenburg Neighbor Law) to terminate buildings at the boundary to neighboring properties; in the case of low-rise residential buildings, construction as neighbor walls (§§ 9 to 15 of the Brandenburg Neighbor Law) is permissible,
[*]as external firewalls to terminate buildings constructed within a distance of no more than 2.50 m from the boundary to neighboring properties, unless a distance of at least 5 m to existing or legally permissible future buildings according to building regulations is legally secured,
[*]as external firewalls between consecutive buildings on the same property,
[*]as internal firewalls to divide extensive buildings at intervals of no more than 40 m,
[*]as internal firewalls between apartments and other units in buildings, if particular fire hazards arise from the other units.

Sentence 1 Nos. 1, 2, and 3 do not apply to outbuildings without living spaces and without fireplaces with no more than 75 m3 enclosed space.

I assume that after the last sentence, no firewall is required.

But roughly 6x6x2.5 is more than 75m^3

Oops... I assumed square meters.

What is on the neighboring property or how far away is the next building?

On the neighboring property, approximately 10 meters away, stands the house, and exactly on the boundary where our garage is supposed to be, the neighbor also wants to set up theirs.

Why not team up and switch to precast concrete garages then?

The price difference in scents is not that big now, especially since steel garages somehow give me the creeps.
