Floor area ratio calculation when 2 parcels need to be combined

Hello,

my searches have not yielded any suitable topics for my concern, so I will try it with my first own topic.

My question revolves around the calculation of the floor area ratio when the construction project consists of 2 parcels.

Situation:
- Actually a 4-fold divided property
- Each with 3 parcels for the houses
- 1 parcel for the driveway (common area with 1/3 co-ownership share per house party)

If I now want to calculate the floor area ratio for one of the properties, how do I proceed?

Plot of the respective house + 1/3 of the parcel of the driveway as the basis for the calculation? In other words, do you combine several parcels (e.g., House 1 + share driveway) into one property and then calculate the floor area ratio according to the respective development plan?

Even though someone will soon complain again that I shouldn't regret the alienation of "our" expert : he could have told you that with absolute certainty :-(

So now I'll try it as an apprentice wizard: the keyword is "Realteilung". The access road here is its own parcel instead of a GFL area within one of the other three parcels, and therefore - even proportionally - cannot donate its "unused" floor area ratio to any of them. So here, each parcel can only be the basis for the floor area ratio calculation of its respective development.

There, the floor area ratio I was proportionally allocated to the building land. The driveway then falls more under floor area ratio II. However, I think this can only be clarified with the local building authority. Presumably, each municipality regulates this as it sees fit.

At Tolentino, his property immediately serves the rear tenant, i.e. the GFL corridor is part of his property and not, as in the present OP's case, an independent parcel.

You mean the plots were first divided and then the development plan was created? If that were the case, the driveway plot would have nothing to do with the floor space index of the other 3, right? That is an independent plot. That would be like counting the street in front of my house towards the floor space index.

Yes, for me it is my property on which a GFL right has been registered for the rear property owner. In the land register (civil law) and in the register of building encumbrances (public law). But it is mine, so I also have more area to build on (not on the strip, but overall). The driveway itself only counts (for us) as sealed surface if it is actually sealed. So with gravel, grass pavers (stones), or even permeable paving, it may be that it is not counted at all.

In the present case with the OP, I also fear that the area of the access property is not allowed to be counted towards the floor area ratio potential. But probably it would be stupid anyway, because if it is not paved in a permeable way, a fully sealed area would actually deduct something here....
